The Rumson Planning Board finally came to some resolutions for Rick Jones and Cindy Zipf's appeal of the tree removal permit for 35 Navesink Avenue.
For the Rumson citizens concerned with what will be done about the removal of so many trees on Navesink Avenue back in May, the wait is over. At Monday night's Planning Board meeting, the Rumson Planning Board ruled that the tree removal permit for 35 Navesink Avenue must be modified to require the additional planting of trees. The board ruled that the remaining trees are protected and erosion control measures are implemented. Rumson residents Rick Jones and Cindy Zipf have been fighting for answers and seeking some resolution to what they call a clear cutting that occurred next to their home. The clear cutting case of 35 Navesink Avenue resumed Monday night. Final decision pushed back until October 3.
Tensions were raised at Monday night's Planning Board meeting as the board came closer to resolving the clear cutting case on 35 Navesink Avenue. The hearing was a continuation of the August 1st Planning Board meeting where Rick Jones and Cindy Zipf, along with their lawyer Andrew Provence, first presented their case. Jones and Zipf are appealing the actions of town officials which they feel led to clear cutting on 35 Navesink Avenue. At the August 1st meeting, the construction developer of 35 Navesink did not attend. Rumson resident Rick Jones submitted an appeal against the lack of administration and enforcement of the Borough's Tree Protection Ordinance.
According to resident Rick Jones, there seems to be a serious conflict of interest amongst the code enforcers in Rumson. "We feel that there is a serious conflict of interest when the town official who wasn't administering and enforcing an ordinance properly is the same person who sends you requirements for an appeal and is the same person who will be the Secretary of the Planning Board when the appeal is heard," Jones said. Residents believe the Environmental Tree Protection Ordinance was violated and clear cutting occurred in their neighborhood.
Rumson residents are frustrated and angry about what they are calling a clear cutting on Navesink Avenue. Over twenty Rumson residents attended the council meeting on June 14 to discuss an “egregious act” that took place on Navesink Avenue. Residents, led by Cindy Zipf and Rick Jones, say the builders on their neighboring lot have committed a clear cutting of a fully wooded lot of mature trees over the past couple of weeks. “Most in the neighborhood and other Rumson residents are outraged,” said Zipf. “We are devastated.
