Committing adultery can be expensive in more ways than one. Not only can it be devastating to the longevity of your marriage, but it can also have financial consequences. But not for the cheater, the consequences would be for his/her paramour.

Alienation of affections was first introduced as a legal concept in the late 19th and early 20th centuries. Since then it has been abolished in 42 states, but remains on the books in Hawaii, Illinois, Mississippi, New Mexico, North Carolina, South Dakota, and Utah.

The suit is brought by the deserted spouse and the "third party" is held responsible for the failure of the marriage. Alienation of Affection is a very difficult tort to prove. Don't forget, according to the American system of law, right or wrong, guilty or not, the paramour will have to pay for their own defense.
