Don't Text Someone Driving or You Could Pay - Tips from Joanne S. Nadell, Equire

Every day we all hear advertising and public education announcements warning about the dangers of texting while behind the wheel.  

While this is such a no brainer, how many of you would ever admit that on almost a daily basis, you are guilty of such a wanton and reckless act?

However, did you also know that if you are texting your friend, who then has an accident as a result of looking at the text from you, that you could be held liable for damages.

The New Jersey Appellate Court has held that such liability can be imposed if it can be proven that the sender KNEW the driver was operating his vehicle at the same time.

 The moral of the story is to please stay safe and don't text when you're behind the wheel. Plus, don't text a friend when he's driving and put both of you at risk for serious pain and trouble.  You both could pay in more ways than one.
